DWP Independent Case Examiner Overwhelmed By Complaints

The DWP (Department of Work and Pensions) Independent Case Examiner also known as ICE has revealed that they are overwhelmed by a huge amount of complaints from claimants.

This was revealed when they responded to an MP’s written question recently in parliament.



ICE is an organisation used by the DWP to deal with claimant’s complaints against the DWP. This is the next step when a claimant has exhausted the DWP’s internal complaints procedure and is still not satisfied with the response given.

Complaints against the DWP can be for various reasons including and not excluding others;

A failure by the DWP to follow proper procedures

Excessive payment delays for benefits

Sub standard customer service given to claimants.

It’s also noted that there has been a 17% increase in the number of complaints made to ICE in the year 2021to March 2022.

In itself may not be seen as a huge increase, however it is an increase and should be dealt with in the utmost urgency



However the huge increase in complaints arises in the proportion of cases that ICE has agreed to look into. This has increased by an astonishing 68% in the last year.

This therefore means that ICE is receiving a huge increase in complaints where it believes that there is a case to answer than in previous years.


As a result of this increase there are now 1,249 cases waiting for an ICE investigator to be allocated. The average time for a complaint to be dealt with currently takes is 53 weeks,so in total this means that it takes over a year before an investigation begins.

Personally I don’t know any person making a complaint against the DWP that can afford to wait that long albeit for financial and other complaint reasons.

It takes a great deal of courage to make a complaint against the DWP and as a result many don’t make complaints when they should do.

The complaints procedure is complex and very stressful for everyone making a complaint against the DWP and as a result it can impact a person’s health and ability to manage their daily life’s.

It comes as no surprise that legal justice that claimants are entitled to is subject to long indefensible delays without question.

It’s also noted that the DWP can make a decision to apply cruel, harsh and often unwanted sanctions on the most vulnerable and in need of help whilst their real and valid complaints.

Once again it’s one rule for claimants and yet another for their oppressors.

I’m still here. My continued battle with Long Covid and good memories.

Dear readers an extra blog post from me, I hope that you don’t mind.

I’ve been a tad quiet recently because my recovery has been set right back.

My daughter unknowingly brought home a nasty virus with her when she returned home from school about two weeks ago.

What would normally would have been a slight cold etc completely floored me. I was forced to retreat back to bed.

I really hated having to retreat to bed because I wanted to be out and about and I had plans to do ‘stuff’.

I’m now out of bed but I’m coughing a lot and I can’t get my stats above 94 to 96. I’m also experiencing the return of the stabbing pains.

Yes I know that I should go back to the hospital and I will do when I’m financially able to do so. Shite happens and I’ve got to learn to deal with it.

I was looking at my Facebook memories today and I was reminded of the email that I wrote to The Scum (Sun) after the requested my help for them.

I’ll paste the letter below, it really made me chuckle.

How dare they have the nerve to request help from me after I had just published a petition against them that went viral.

I was advised to take it down, but hindsight is a wonderful thing isn’t it. I should have kept it up and fought them. I’m quite sure that I could have found legal advice.

I will not make the same mistake again.

Anyway here it is.

My reply to The Sun On Sundays request yesterday.

Hi Gareth,
Thank you for your email.
Primarily I need to correct you on your referral to Universal Credit as being Universal Credits. These are different things, and although I don’t want to argue about semantics, it is about conveying the correct message across. Therefore using the correct benefit title is very important isn’t it.

I’m sure that you will agree with me.
As you can tell, I’m rather fussy about the getting the correct message out to the public. After all the public deserve to be correctly and reliably informed about important issues, especially in newspapers and the media. However this is something that The Sun Newspaper has regretfully been doing a terrible job of.

Headlines such as ‘Benefit scrounger mum of 8 says £500 a week handouts aren’t enough for her four bed council house’ Dan Sales 18th February 2017.

Other headlines such as ‘Takers dozen. Sponging mum of 13 who rakes in £30,00 a year in benefits is branded a scrounger by her own daughter’ Alex West 30th December 2016. ‘Family planning. Scrounging mum of 12 Cheryl Prudham who pockets £40,00 a year in benefits flashes her tummy outside medical centre days before announcing shes expecting baby 13.’
I could continue sharing these headlines with you, however you get the gist don’t you.

Not only were these headlines not based on fact, not researched correctly they were damaging to the people concerned and to the most vulnerable people of this country and were created specifically to cause prejudice and division towards the poorest of this country, the very people that your newspaper is now reaching out to.

These headlines were so hard hitting, a phrase that you like to use, that as a result of the ongoing campaign of hatred against the poor, led by The Sun newspaper, other newspapers and television channels, I, myself have been shouted at, called a scrounger, told to get a job, and spat at. Luckily it didn’t touch me, but you can see how this works out right?

The people that I help have also experienced prejudice as a result of this ongoing campaign and do so on a daily basis.
I can never forget the “Scrounger Awards’ that The Sun newspaper published, also ‘The Welfies’ and the ‘Job Dodger’ awards.

Sympathetic also isn’t something that I associate with The Sun newspaper, after all we can never forget Hillsborough can we.

A point to note, lying has 5 letters, but so does truth. Hurt has 4 letters but so does heal. Everyday I try and rectify the harmful and malicious lies set about by The Sun newspaper.

Maybe the newspaper could do the same.

I therefore would like to decline your offer of a chat, nor will I be referring any vulnerable people to your newspaper to talk. You see, I simply cannot trust the newspaper not to twist their words and to turn them into figures of hatred.

However, we would like an apology from The Sun newspaper for all the hurt, damage and discrimination caused by the words printed in your newspaper.

Wouldn’t it be nice if that was a front page headline instead of a Benefit Scrounger headline.

How am I doing otherwise?

Trying to cope is an adequate description atm. It’s the same old fed up of being ill and sick to death of being skint. I’m sure that you can relate to this.

I’d love to be able to do a good supermarket shop instead of having to buy essentials online because it’s so expensive.

I just want to be normal again.

It’s so bloody depressing but it is what it is. But I have got good memories to look back on and I’m grateful for that.

One thing to look forward to is Halloween, my favourite time of the year.

My daughter has found the Halloween decorations so when I’m up to it I’ll be able to transform the front garden.

Covid 19 the unwanted gift that keeps giving.

Dear readers it’s been a tough old week for me and my Covid 19 battle.
Sadly I rebounded again and I’m now completing my fifth round of antibiotics.

Tough yes but however I do know and I appreciate that I have it much better than many have had it. I’m alive and I’m very grateful for that.

So yesterday I ended up back at the hospital with yet another reoccurrence of the pains that I’ve been getting.

I wanted answers, I wanted to know why I keep feeling like this. I hate the unknown which doesn’t fit well with Covid 19.

I had my bloods taken, x rays and scans done and I waited for the results.

Eventually I saw a lovely doctor who totally got it, he understood exactly what I’ve been going through.
He explained that my bloods are OK but from the scans he could see scarring on my lungs.

I then asked him about the pains and my sometimes galloping heart rate.


The answer was this. Because of the pneumonia and pleurisy my lungs have taken a battering and the pains are as a result of the remnants of the above and the scarring.

I asked him about my heart rate and he said that my heart appeared to be ok after being on a heart monitor. He said that lots of people who have had covid 19 get this and so far they don’t know why.
He’s referred me to a respiratory specialist and another specialist regarding my heart rate and for more tests.

Covid 19 damages your body in so many ways and because its an unknown virus it’s hard to get answers about anything.
Research is being done though and maybe we will get some answers soon.


I got some very good advice from the doctor and my friends. I need to stop trying to to too much, I will heal but it takes quite a long time to get back to somewhat normality.

This doesn’t mean that I’m going to give up campaigning though, infact it means the opposite.

We need to continue to campaign more than we have done before.
Our rights are being eroded away at a fast rate and so many things are being missed because of the Covid 19 pandemic.

Every day I publish the official Covid death rates, you know the deaths that the government wants us to forget about. They want the public to forget about Covid 19. It’s up to us to continue to publicise them.

Covid 19 is still having a massive impact both national and locally.

Whilst I was at the hospital yesterday I saw three very ill people being admitted to the hospital because of Covid 19. I know this because covid patients are being directed to another specialised department.
Their stories are the stories that the public don’t get to hear. The man that collapsed at home because of covid, the woman found in her bed seriously ill, the man that walked into the department and nearly collapsed when he got there.

Remember that their and our life’s don’t matter to the government and to some local authorities. Out of sight and out of mind.

Please keep in mind that telephone medical assessments are taking place once again.
If you have to have one of these examinations treat it as if you were at their medical centre.
Have a list of all of your medications and illnesses or disabilities. Try and have someone with you and ask them to take notes also.

I’m going to continue to plod on as I say, trying my best to give my daughter a good childhood despite having a very deminished income.
I can honestly say that I’ve never felt so bad about being a bad mother because I can’t give my daughter what her friends have.
Every day I feel this guilt like many parents do. Tough some say, that’s life. Except that it shouldn’t be like this.

The kindness and support of my friends has kept me going as have OUR NHS.
I’m determined to be back out there ASAP but I’m still helping people the best way they I can from home.

I want to thank each and every one of you for the support and friendship that you have given me. When I say that it means a lot to me I really mean it.

Stay safe everyone, wear a mask and wash your hands. Self isolate if your vulnerable and do whatever is right for you to continue.

I dream about being able to eat fresh fruit and vegetables.

Dear readers what a horrible week it has been in parliament, I’m certain that you’re feeling the ramifications of this.

At the moment we are having to put up with a government that throws constant hatred out towards others with absolute no ramifications at all. Their hostile environment has certainly become a whole lot more hostile.

Right wing politicians, newspapers and followers are being encouraged by the government to abuse people especially left wing politicians and individuals.

I’ve had to start carrying a personal alarm with me at all times.It saddens me greatly that this is happening, we already have enough to cope with trying to survive from day to day.

This week I will be concentrating on one conversation that I had this morning.

All food parcels were taken as soon as they arrived. It’s not becoming better it’s getting much worse.

Whilst I condone the need for foodbanks the realisation that thousands of people would have either died or become extremely ill without them.

It goes without saying that the Tory party don’t give a stuff. But we already know this don’t we.

Every week for years now I’ve had some lovely conversations with some amazing people trying their best to survive whilst dealing with the DWP system. They’re the true heroes of society not someone wearing a suit and spouting all the right words. To survive the DWP system is a massive achievement and we need to recognise this more.

This morning I had a conversation with a lovely chap, I’m probably the only person that he talks to all week. He’s always got a smile to spare for others but he’s suffering greatly.

He hasn’t been able to have a proper cooked meal for a long time, and told me that he couldn’t remember the last time that he had been able to eat properly.

Being constantly hungry and having to rely upon foodbanks is taking its toll both mentally and physically. Mentally he’s feeling completely worn down, he’s trying his best but not achieving much in the DWPs eyes. He knows that he needs to find work but it’s hard, very hard.

Physically he’s feeling terrible. He’s unable to buy fresh vegetables and fruit and his diet which mainly consists of tinned food and cheap carbohydrates is taking its toll, telling me that he dreams of being able to buy some fresh vegetables and fruit and eating them. He knows the importance of a good diet but how on earth can he eat healthily when he hasn’t got the ability to do so.

This is a massive problem in society at the moment but it’s rarely spoken about.

It’s easy to become overweight when relying upon cheap quick food yet the media fat shame just about anyone they can find who happens to be overweight.

Dieticians and celebrity chefs can have as many programmes as they want on television to teach is how to eat healthily but they haven’t got a clue about what the reality of the situation is.

We don’t have enough money to buy fancy ingredients or the next new superfood whatever that might be at the moment.

Jack Monroe appears to be the only one that does know because she’s lived the foodbank life. Check her work out she’s fabulous.

We can’t afford to eat properly we’ve only got the means to survive.

If you take any message from my blog let it be this.

We aren’t responsible for the way that the government is treating us. Poverty is extremely hard to escape from, it follows us about everywhere.

You are not to blame for this.

Don’t listen to the Tories when they say that finding work pays. It doesn’t and this has been proven time and again. Universal credit has been created to make us fail, to make us dissappear, to make us give up.

Almost every person that I spoke to today was suffering because of the system that’s intent upon making them fail.

I want to tell the man that I spoke to today who’s too ill to work but is forced too look that he doesn’t have to look for work.

Basically I want a magic wand to stop this eternal suffering felt by thousands upon thousands of people every day.

I want to bring back industry to areas like mine where there is none. I wnt suitable jobs for everyone who is able to and wants to work. I want employers to be flexible around childcare and other family duties

I want people who have a disability or are ill to be respected instead of being failed at every step and constantly punished for existing.

I want a society that understands that not everyone has access to the Internet or a computer.

I want to see the end of universal credit and it be replaced with a fair and understanding system that helps not punishes people.

I want everyone to live in decent housing, not stuck in a B&B or suchlike. Everyone deserves a good place to call home.

I want everyone to be able to have a good and varied diet without worrying where their next meal is coming from and when.

I want children to be happy, not hungry and certainly not worrying about when they’ll get their next meal and certainly not to be forced to wear clothes that they’ve grown out of because their parents can’t afford to buy new ones.

I could go on forever but you get the jist.

What I can do though is to buy some fresh fruit and veg for the chap that I was speaking to today.

I can continue to help others and advise them. I can become a friend to them and I can be a shoulder to cry on. I can do this and I will continue to for as long as I’m able to.

I apologise for this weeks rant. Today hit me very hard, we’ve now become so poor that instead of dreaming about going on holiday or suchlike we’re dreaming about being able to eat fruit and vegetables.

Sad, bad times indeed.

£213 a month to live on, and also have to top up rent payments with that. People are struggling to survive on universal credit.

Dear readers, today was grim and the weather didn’t help anyone, let alone the people forced to use the Jobcentre. Yet again we encountered numerous people with all sorts of problems ranging from universal credit, ESA and PIP, housing problems etc.

We handed out all of our food parcels, most were taken by single parents with children and working families. They rely on foodbanks to survive, it really shouldn’t be like this.

As usual I won’t divulge the names of anyone that I spoke to this morning. The DWP snoop everywhere and I don’t want anyone that I spoke to being targeted by the DWP. This does happen, but not on my blog. I value everyone that I speak to unlike the DWP.

 

John walked out of the Jobcentre clutching the usual list of phone numbers that they hand out to everyone. I handed him a leaflet and asked him if he needed any help. John told me that he was ok, but thats only because he’s living with a relative that can feed and look after him whilst he’s waiting for his universal credit claim to be processed, saying that the alternative is to horrible to think about.

 

I then spoke to Gemma. Gemma has struggled almost all of her life, she’s 19 years old and to be honest isn’t enjoying anything about her life at the moment. In her short lifetime she’s been homeless twice and has been rehoused not long ago.

Gemma is claiming universal credit and is finding it almost impossible to manage. She receives in total £513 a month total to live on after paying her rent payment. Out of this she has to pay back her rent arrears that she keeps accruing because she’s finding it hard to pay her full rent. She also got into rent arrears whilst she was waiting for her universal credit claim to be processed, “What are you supposed to do, just pay your rent with the loan that they give you? It was impossible for me to pay my full rent because I needed food to eat, and gas and electric to buy. I’ve got no one to borrow money from, and that’d have to be paid back as well.

To make the situation worse Gemma also has to repay her universal credit loan back at £100 a month. There’s absolutely no regulation concerning the repayment of loan debts. No set amounts that people have to pay back, sometimes I think that they pick a number out of thin air and decide thats how much they should pay back. It’s ludicrous

Basically after all of her above debts are paid back Gemmas left with £213 a month to survive on. She’s got to buy gas, electric, food and transport costs. She’s a broken woman at 19 years old. Huddled up in the cold, Gemma muttered “It’s almost as if they’re trying to destroy me. I’m 19 years old and I’m worn out because of the stress and worry. There’s a good chance that I’ll become homeless again, and I’m doing my best. Universal credit is destroying me. They look at me (DWP staff) as if I’m stupid, like I’m something on the bottom of their shoe. They don’t want to help me”

Gemmas 19 years old, at the start of her life and should be enjoying life. Instead she’s worn out, depressed and feels like giving up. This, my friends is what universal credit does to people. It eats you up, totally consumes you until eventually you give up. That’s exactly what its designed to do.

 

Sarah is a single parent and is also having a difficult time. She’s claiming universal credit and to say she’s struggling is an understatement. Here’s her story.

Sarah was instructed to attend an appointment, which she was ready to do but unfortunately one of her parents suddenly fell ill and was rushed into hospital by ambulance. Sarah was with her relative when this happened and from the ambulance she telephoned the DWP to try and rearrange her appointment. The person that she spoke to said that this wouldn’t be a problem, and they’d phone her later with another appointment.

Only the DWP phoned the wrong number. Not the one that’s registered online, an old number that isn’t used anymore, and Sarah had already informed them about this.

Sarah also couldn’t remember her 16 pin log in details. How on earth is anyone supposed to remember this, its impossible. Even if people write it down its easy for it to get lost. If they put it in their mobile phone (if they have one) and the phone breaks, then the numbers missing.

Sarah phoned the DWP to tell them that she’d forgotten her PIN number. The DWP then told her that she had to go online to get the number. Sarah couldn’t access her online account because she didn’t have her pin. Basically they gave her an impossible task to complete.

Upon attending her next DWP appointment she was told that the DWP were deducting her universal credit payment by £200 but don’t worry, we’ll give you a LOAN for £150 that you have to pay back. Are the DWP getting their ideas from illegal money lenders or something? This is atrocious.

Basically Sarah was fined £200 for missing a phone call that she never received because they phoned the wrong number, and for loosing her PIN number. You really couldn’t make this shit up could you.

Sarah is also in rent arrears now because she was unable to pay her full rent because she was sanctioned. She now has to top up her rent payments and repay two DWP loans back.

Don’t forget Sarah is a single parent with a very young child, she didn’t have any food in her cupboards and didn’t know what to do. Luckily I gave her a food parcel and advised her on what to do. Hopefully she will access local services and she will appeal her sanction.

It’s despicable that people are treated in this manner, not only are the parents suffering but their children are too. The DWP just don’t care. It’s no coincidence that more and more children are being put into the care system is it. Many parents can no longer provide food, heating, clothing etc for their children and it’s not their fault. The blame lies purely at the governments feet.

 

I asked an older man how was he coping with universal credit. He looked at me and said ‘Just about. Now I’ve got to pay my council tax”

 

I spoke to a young woman working a zero hour contract at a local cake factory. When she started her job she was told that if she worked hard she might get a contracted job. She worked hard but never got the contract. Now she has no job security at all.

 

Gordon spoke to an older woman aged 62 who’s claiming universal credit, she’s struggling but then again nearly everyone claiming universal credit are aren’t they.

 

We then had a conversation Brian with an older man, he claims ESA and was told to phone an 0845 number recently. He wasn’t very clear about why he was told to phone this number up. He’s confused because the system is extremely confusing.

Brian has a contract phone and his phone bill per monthly is £15 a month. Brian tried phoning this number numerous times, each time he was placed on hold for great lengths of time. When he received his bill it was £54.

Of course he was angry, he shouldn’t have cost him  this much, all calls to the DWP should be free, but many still aren’t.

Brian was angry, frustrated and echoed concerns for those without a mobile phone contract saying ‘How the hell are they going to pay that? They’ll never get any help if they don’t have a phone will they’ He realises the systems rotten, and wondered why the government are allowed to do this ‘It’s criminal’ he said, and he’s not wrong.

 

Jack, a local councillor  represented a claimant whilst they had an appointment, this helps a great deal and I can’t recommend this enough. More should do this if they’re able to.

 

We left todays demo cold and a bit downhearted, but knowing that we’ve helped people makes everything worthwhile.

Today we released doves and laid a wreath in memory of everyone that has died as a result of the government’s war against the poor and disabled.

Dear readers as many of you will know we have a special Christmas memorial service outside Ashton Under Lyne Jobcentre every year.

We do this in memory of every person who have died as a result of the government’s heartless treatment of the poor and disabled. I call it a war against the poor because that’s exactly what it is.

Of course the government have taken away many of the means that people can fight back in the way if appeals etc. Legal aid is almost non existant and organisations that help people have had their funding cut to the bare minimum.

Be aware that this is all done purposely. The government regards us as a burden, not worthy of any help. In fact not worthy of anything.

So five years ago myself and others decided to fight back. I personally know people that have committed suicide because of the government’s cruel regime as have others. I felt that I needed to take a stand so here I am five years later.

The awful fact is that more people are committing suicide than ever before, more people are forced to live in extreme poverty than has been known in modern times, but still all the press are interested in is what Jeremy Corbyn did or didn’t say.

People are dying. A further three million people will be forced into poverty next year due to the further roll out of universal credit. Myself I feel that number is quite low.

Even more children will be forced to go hungry, their parents will be even hungrier. Homelessness will increase drastically due to the long wait for a universal credit payment to be processed and landlords not wanting anyone claiming any type of benefit to live in their properties.

Many self employed people will be forced out of self employment because they don’t fill the government’s impossible remit for self employment under universal credit.

More and more disabled people will be persecuted by the government, be made to go hungry and not able to access the care that they desperately need.

We need to continue to fight against this cruel government and to be honest we need to stop being so nice about it.

Remember this could happen to you and the safety net that you were relying on to catch you is no longer there.

I spoke to lots of people today, none of whom could afford food over Christmas. We handed them food parcels which will tide them over until next week.

I had a conversation with a young working single parent. She says that her life has been destroyed by universal credit.

She took a loan out from the DWP to tide herself and her young child over until her claim was processed. She now has to pay this loan back at the cost of £150 a month.

After paying all of her bills off she’s left with £90 a month for her and her son to live off. To buy food etc.

Could you manage on this small amount? It’s impossible, so she’s now reliant upon food banks to literally keep them both alive.

I helped and advised her and handed her a food parcel. I wish that I could do more but I can’t.
